An ordinance is a legislative act by the legislative body of a municipality (selectboard, council, aldermen, trustees). Black’s Law Dictionary defines an ordinance as “[a]n authoritative law or decree; specif[ically], a municipal regulation, esp[ecially] one that forbids or restricts an activity.”

Municipal ordinances carry the state’s authority and have the same effect within the municipality’s limits as a state statute. Once adopted according to statutory process, they become legally enforceable local laws. A municipal ordinance is designated either as a civil or criminal offense and may carry a fine or penalty of up to $800. 

A policy is a course of action, guiding principle, procedure, or strategy that is adopted by a municipal public body (e.g., a selectboard or board of library trustees). Policies are executive in nature and are oriented inwards to guide internal decision-making processes. Generally, policies apply to employees, town facilities or the public body itself.

A policy is designed to influence and determine decisions in the course of conducting certain municipal affairs. Policies should establish clear-cut, orderly, and systematic methods for handling certain administrative duties and internal town operations. They should be flexible enough to meet changing situations and conditions, yet provide enough consistency and continuity in making decisions to ensure predictability.

 

Burn Ordinance

This ordinance is enacted to promote the health, safety, and general welfare of the inhabitants of the Town of Hartland and to prohibit solid waste disposal practices that pose a danger to the public health and welfare and the environment or that constitute a public nuisance.

Class IV Road Policy

Class 4 highways are recognized to be a valuable public resource, and every reasonable effort should be made to retain the public access to these town highways. The purpose of this Policy is to define the standards by which the Town will protect, maintain, and reclassify its Class 4 highways, and to set reasonable expectations for the use of those highways.

Construction Permit Ordinance

The purpose of this Ordinance is to create a permit program to inform the Town of new building and construction projects.  This Ordinance is adopted under the authority granted in 24V.S.A. §§2291(14) and (is) (Defining Public Nuisances); 19V.S.A§1111 (Permitted Use of Right-of Way); 24 V.S.A. § 4424 (Flood Hazard Areas); 32 V.S.A. Chapter 129 (Tax Grand Lists); 30 V.S.A. Chapter 87 (Enhanced 911, Emergency Services); and 20 V.S.A. Ch. 1 (Emergency Management).This Ordinances hall constitute a civil ordinance within the meaning of 24 V.S.A. Chapter 59.

Dog Ordinance

It is the purpose of this article to regulate the keeping of dogs and wolf hybrids, to protect the public health and safety and to protect the residents' quiet enjoyment of their homes and properties.

Flood Hazard Area Regulations

In accordance with 10 V.S.A. Chapter 32 and 24 V.S.A. § 4424, there is hereby established a bylaw for areas at risk of flood hazard and fluvial erosion in the Town of Hartland, Vermont.

Gifts and Memorials Policy

From time to time the town may be offered physical or monetary gifts to memorialize or commemorate people. The Selectboard will consider acceptance of gifts on a case-by-case basis using the criteria in this document.

Highway Ordinance and Culvert Policy

Pursuant to the provisions of Section 43 of Title 19 of Vermont Statutes Annotated, an ordinance pertaining to the construction and layout of proposed new highways, driveways abutting on and having access to state and town highways and the Town policy on culverts is hereby adopted by the Selectpersons of the Town of Hartland this nineteenth day of April 1982.

Highway Right of Way Policy

Any person who wishes to perform or arrange for maintenance, repair, restoration, installation, and/or improvement on a town highway or legal trail may do so only after receiving a signed Right-of-way Permit from the Town Manager or their designee. Permission for maintenance shall be given in accordance with 19 V.S.A. § 1111 and the Town's Highway Ordinance and Culvert Policy.

Junk Ordinance (Ordinance Regarding Dumping of Garbage and Refuse)

To protect the public health, safety and well being, and to promote the responsible use of resources and protection of the environment, the Hartland Selectboard  hereby adopts this ordinance to regulate outdoor storage of junk and junk motor vehicles.

Leases of Town Property and Buildings

Legal Trail Policy

Legal trails are recognized to be a valuable public resource and every reasonable effort should be made to retain the public access to these byways for recreational purposes. While the Town encourages the use of these public spaces, it also has a responsibility to protect and preserve the trails and to minimize the negative impact of their use on the environment and on adjacent landowners. This policy outlines how the Town of Hartland, VT, will maintain and protect its existing legal trails and designate new trails, and sets out what activities are allowed and not allowed on Hartland's legal trails.

Ordinance Prohibiting the Mining and Milling of Uranium

The Hartland Selectboard, in the exercise of their powers pursuant to 24 VSA #2291(14), define public nuisance as an activity that disrupts the comfort and convenience of the general public by adversely affecting some general interest or common rights. 

The Hartland Selectboard has reviewed information concerning uranium mining and milling in the nation. The Board, as a result, finds and declares that uranium mining and milling, whether conducted singly or together, constitute a public nuisance in and near where such activities are conducted.

Ordinance to Regulate the Road Speed of Motor Vehicles

The Selectboard of Hartland in the County Windsor and the State of Vermont, acting under the authority of Title 24 VSA Section 2291 (4), hereby establish a maximum speed limit of 35 MPH on all town roads, unless otherwise posted, within the boundaries of Hartland.

Policy on Maintenance and Improvement of Town Highways (Roads and Tree Policy)

This policy provides guidance to town officials and information to residents and landowners about maintenance, improvements, and alterations to Class 2 and 3 town highways. Town policy on trees within the limits of public ways and places is included in this document.

Selectboard Policies

Sewage Disposal Systems Health Ordinance

Any person who intends to build, replace or alter a sewage disposal system on any lot size shall submit an application for a Construction Permit to the Health Officer or his authorized agent.

Smoking Policy

The purpose of this policy is to protect the health and well-being of all members of the public who have occasion to attend activities at Town recreational parks and facilities, by restricting the use and disposal of tobacco and marijuana products as outlined herein.

Traffic Ordinance

Pursuant to the authority granted by 23 VSA, 1007, 1008, 1105, and 1753, and 24 VSA, 2291 (4), and in order both (1) to protect the safety and facilitate access of residents, users of the town highways, and emergency service providers, and (2) to maintain a safe traffic flow, the Selectboard adopts this traffic ordinance for the Town of Hartland, Vermont.

Vendor's Ordinance

In order to maintain safety of buyer, seller, and passersby, and to minimize disruption to vehicle traffic, this ordinance regulates individuals or organizations selling or offering any product to the public from a vehicle or at a location alongside town or state/federal highways.
